Divorce in Georgia: use the court's own pages

We are still checking Georgia's divorce rules against official sources. Until then, the court's own pages have the forms and the steps.

Official pages for Georgia

Filing fee

Ask the Superior Court clerk in your county for the filing fee. If you can't pay it, ask how to file without paying.

Residency

You (or, if you live elsewhere, your spouse) must have lived in Georgia for at least the past 6 months before filing.

With children

In a divorce with children, the Judicial Council's checklist includes a Divorcing Parents Seminar certificate. Ask your superior court clerk which seminar your circuit uses.

Were you served?

The papers you got (the summons) state your deadline to answer. Ask the court clerk to confirm it, and contact a legal aid office right away if the deadline is close.

If you are in danger

If you are in danger, call 911. The National Domestic Violence Hotline is free, confidential and open 24/7, in English and Spanish: call 1-800-799-7233, text START to 88788, or chat at thehotline.org.
